Examine the powers of the constitution in Chapter 4 of the Magruder text, then answer the following: a) Define expressed powers, state where these are found in the Constitution, and give an example. b) Define implied powers, state where these powers are defined in the Constitution, and give an example. c) Define reserved powers, state where these powers are defined in the Constitution, and give an example. 2. Review the case McCulloch v. Maryland in Chapter 4, Section 1. a) Describe the issue in the Supreme Court case, McCulloch V. Maryland, 1819. b) How did Chief Justice John Marshalls Court decide the issue? c) The McCulloch case was not the first time the Supreme Court held a state law to be unconstitutional. Identify the case and year, the Court first struck down a state law. 3. After watching the mini-lecture on federal versus unitary systems, answer the following questions: a) Briefly describe an example of states acting as a laboratory of democracy, that is, enacting a policy that might later be adopted by the national government. Do not use the examples from the lecture. b) Briefly describe an example of states resisting national policy. Do not use the example of civil rights policy or environmental policy in general; you may use a more specific example in these areas. c) Identify an area where there may be a significant difference in either resources or policy implementation among the states, that is, where critics might claim a disparity that is unfair or unequal. Do not use the examples from the lecture, that is, education funding or criminal penalties.
