With that information in hand, analyze the merit of using criminal and/or civil law enforcement powers to regulate environmental use and protection.

The text discusses at length the bland concepts of law at all levels and forms, from Constitutional law down to civil and criminal procedure codes. That ignores the reality of the agencies taking action based on their statutory and regulatory powers and the results of their actions.

To see the reality of the enforcement action and power of the Environmental Protection Agency, look at the thousands of actions taken by the EPA across the United States just in 2018:

If you choose to zoom in on more specific enforcement south Florida, you will find enforcement actions in our own backyard (so to speak).

Gulfstream Park Racing Association, Inc. Clean Water Act Settlement

There are countless other civil enforcement actions:

including Florida:

Additionally, due to the sensitivity of the environment in Florida, there are continuous licensing, monitoring, and investigation processes ongoing (just a few):

At least one business you will recognize had issues:

https://echo.epa.gov/detailed-facility-report?fid=110013301998

Just as importantly, criminal enforcement (prosecution) actions (the EPA is behind in posting date, here is 2017):
https://www.epa.gov/enforcement/2017-major-criminal-cases

Here, again, at least one business you are likely to know has been prosecuted for environmental violations:
https://echo.epa.gov/criminal-case-report?id=CR_3144
https://echo.epa.gov/criminal-case-report?id=CR_3147

The civil enforcement actions generally resulted in civil penalties and costs required to resolve or restore the harm done (if possible). These fines go into the general treasury of the United States and reimburse the government and include a profit motive for the enforcing agencies to be efficient and effective in their choice of targets for enforcement.

A criminal action out of the Florida Keys shows that a contractor violated coastal environmental protection laws with unpermitted building in waterways:

https://echo.epa.gov/criminal-case-report?p_id=2929

That case actually resulted in a conviction with probation and fines.

For this first substantive assignment of the course, please review the information provided in the text about the history, purpose, and laws of environmental use and protection and combine with the information provided by the links listed above.

With that information in hand, analyze the merit of using criminal and/or civil law enforcement powers to regulate environmental use and protection.

Consider the costs and benefits of prosecution in a criminal case with less-intensive enforcement efforts of civil law enforcement and the societal issues of each. Although the harms done in the civil actions may be much greater than the harms done by the parties in criminal action only one of the cases used criminal powers. Why?

Using APA format, draft and submit an essay that articulates the difference between criminal and civil enforcement of environmental laws and regulations. Your analysis should consider the actions (or inactions) of the parties, the environmental issues involved, the harm done by these parties, and the objectives of the EPA in carrying out these enforcement actions.

Your submission requires a cover page, your text, and reference page, and you shall cite the sources used in your analysis and argument. Including these APA formalities, your paper will be at least six pages long (cover, four pages of text, references).

What are the main opportunities provided by the Gioia method for coding and analyzing qualitative data in the social sciences? Draw on the Gioia paper but also other methods literature to argue for this approach.

1. Exam assignment research design
Below you find the introduction to a scientific article that reports on a study of the use of external scientists to solve R&D problems in firms. Your task is to analyze the way the authors formulate their research problem, using Van de Ven (2007). In particular, you can draw upon chapter 3 in your analysis. Also state an argument whether you approve to the way the authors formulated their research problem or not. Your discussion should be no longer than 500 words.

Article: Bradach, J. L. (1997). Using the plural form in the management of restaurant chains. Administrative Science Quarterly, 42: 276-303

2. Exam assignment qualitative methods
Based on the methods literature and your own experience with working with qualitative data and analysis, discuss the benefits and drawbacks of qualitative data analysis and coding according to the proposed Gioia method (as for instance discussed in the Gioia, Corley and Hamilton, 2013, paper). Discuss the following (Maximum 750 words total):

a) What are the main opportunities provided by the Gioia method for coding and analyzing qualitative data in the social sciences? Draw on the Gioia paper but also other methods literature to argue for this approach.

b) What are the major drawbacks of this approach to analyzing and coding qualitative data? Reference methods literature to argue for your answer.

Evaluation guide

Assignment 1: Research design and problem formulation (maximum score: 20)
Four areas have been evaluated: – Selection and explanation of appropriate framework with criteria for assessment of problem formulation (such as e.g. Van de Ven, 2007). – An analysis of Jeppesen & Lakhanis (2010) problem formulation using this framework, with explicit references to both framework and examples Jeppesen & Lakhanis (2010) text to illuminate the analysis. – Provision of a sound and valid argument for or against the problem formulation using both framework applied with backing from Jeppesen & Lakhanis (2010) text. – General composition and argumentative force of the argument in its entirety, by logic and by backing through concrete examples included.

Assignment 2: Qualitative Methods (maximum score: 40)
Three areas have been evaluated: – Reasoning about the benefits and main functions of the Gioia method, including both its benefits for working procedures and for presentation of qualitative research. The opportunities of the method to contribute to scientific advancement should be recognize. The answer should reflect a sound reasoning about these features, and the core elements of the method as it is specified by Gioia et al. – Reasoning about the major drawbacks of the Gioia method, both for the working process and for the results of the analytical process. The answer should recognize problems and limitations of the use of this particular method for the resulting analysis. – General structure of the argument, the way the answers refer correctly and adequately to methods literature, both from the course and from other sources, and the use of own reflections from the coding exercises.

Studying the Gospels Passage: Luke 10:38-42

Entity Relationship Diagram

Entity Relationship Diagram (ERD) is a deliverable that is created during the logical data modeling process that focuses on the data, unlike a DFD that focuses on the processes. The data in an information system that are created, stored, and utilized by a user are referred to as Entities, Attributes, and Relationships and are represented in ERDs as graphical pictures. In this activity, you will create three Entity Relationship Diagrams (ERDs) in an individual practical exercise utilizing Microsoft Visio®. You will create your ERDs in three different cardinalities, One-to-One, One-to-Many, and Many-to-Many.REQUIREMENTSCreate the ERDs in THREE different cardinalities, One-to-One (1:1), One-to-Many (1:M), and Many-to-Many (M:N), utilizing Microsoft Visio. Identify appropriate questions and their elements used in choosing an evidence-based program.

Instructions
This week is divided into two sections. First, you will focus on defining, refining, and critiquing the concept of evidence-based programs and their connection to theory. Having read and reviewed these resources, prepare a reflection paper on evidence-based programs and practices. Be sure your paper addresses the following:

Include a definition of evidence-based programs.
Determine how these programs draw from theory.
Identify appropriate questions and their elements used in choosing an evidence-based program.
Include an explanation of an evidence continuum that you consider valid when reviewing your topic in health psychology.
Part 1: Define and Refine

Do a practice run using the resources this week and focus on three major elements:

Identify the evidence-based theories being discussed. Define them.
Indicate which questions the researchers proposed that drew them to the theories.
Discuss how the topic is reinterpreted from these theories.
Part 2: Critique Evidence-Based Programs

Finally, pick a research paper that you have previously reviewed, and then review the same three elements discussed above:

Identify the evidence-based theories being discussed. Define them.
Indicate which questions the researchers proposed that drew them to the theories.
Discuss how the topic is reinterpreted from these theories.
